Terms governing access to the MARVELLO Services and purchases made through our online store.
OVERVIEW
These Terms of Service govern your access to and use of the MARVELLO website, online store and related services (collectively, the “Services”), as well as purchases made through the Services.
By using the Services or placing an order, you agree to these Terms, our Privacy Policy and our Returns Policy. If you do not agree, you must not use the Services.
Nothing in these Terms limits any mandatory rights that you have under applicable consumer law.
1 — SELLER INFORMATION
The seller is [LEGAL ENTITY NAME], trading as MARVELLO, with registered address at Herkulesvägen 6, 393 51 Kalmar, Sweden.
Organisation number: [ORGANISATION NUMBER]
VAT number, if applicable: [VAT NUMBER]
Email: clientservices@marvello.eu
The legal entity name, organisation number and any applicable VAT number must be completed before the store accepts orders.
2 — ELIGIBILITY AND ACCOUNTS
You must have legal capacity to enter into a binding agreement. If you are under 18, you may only place an order with the consent and involvement of a parent or legal guardian where required by law.
You are responsible for ensuring that all information supplied to us is accurate, current and complete. If you create an account, you are responsible for keeping your login details confidential and for activity carried out through your account.
We may suspend or close an account where reasonably necessary to protect customers, MARVELLO or the Services, including in cases of suspected fraud, misuse or unlawful activity.
3 — PRODUCTS AND AVAILABILITY
We aim to describe and display our products as accurately as reasonably possible. Colours, textures, proportions and other visual details may appear differently depending on lighting, photography, screen settings and device configuration.
Natural or handcrafted materials may show minor variations. Such variations are not defects where they are consistent with the product description and the nature of the material or craftsmanship.
Products are subject to availability. We may limit quantities, withdraw products or correct product information where reasonably necessary. Any such action will not affect an order that we have already accepted, except where required to correct an obvious error or where performance has become impossible.
4 — PRICES, TAXES AND PAYMENT
The total price payable will be shown before you place your order. Prices displayed to consumers include VAT where applicable. Delivery charges and any other additional charges will be shown separately before checkout.
For deliveries outside the territory in which taxes and duties are collected at checkout, the recipient may be responsible for import duties, taxes or customs charges imposed by the destination country. Where such charges may apply, this will be stated before purchase where required by law.
Payment must be made using an available payment method at checkout. You confirm that you are authorised to use the selected payment method. Payment services may be provided by independent payment providers under their own terms and privacy notices.
If a displayed price is clearly incorrect and you knew or reasonably should have known that it was incorrect, we may reject or cancel the affected order and refund any amount paid.
5 — ORDERS AND CONTRACT FORMATION
Submitting an order is an offer to purchase the products in your basket. An automated acknowledgement confirms that we received your order but does not necessarily mean that the order has been accepted.
A binding purchase contract is formed when we send a separate order acceptance or dispatch confirmation, unless applicable law requires the contract to be formed earlier.
We may refuse or cancel an order for legitimate reasons, including lack of stock, an obvious pricing or product error, failed payment, suspected fraud, restrictions on delivery, or reasonable grounds to believe that the order is intended for unauthorised resale. If payment has already been taken, we will refund the affected amount without undue delay.
Please check your order details carefully before submitting the order. Contact us promptly if you identify an error. We cannot guarantee that changes or cancellations can be made after acceptance or dispatch.
6 — DELIVERY
Available delivery methods, charges and estimated delivery times are displayed during checkout. Delivery times are estimates unless a specific date has been expressly agreed.
We will deliver within the period agreed with you or, if no period has been agreed, within the period required by applicable law. We are responsible for the goods until they are delivered to you or to a person designated by you, except where you independently arrange a carrier that was not offered by us.
You must provide a complete and accurate delivery address. Additional costs caused by an incorrect address, an uncollected parcel or another circumstance attributable to you may be charged where permitted by law and where the costs are reasonable.
If delivery is delayed, your legal remedies remain unaffected. Contact Client Services so that we can investigate and provide an appropriate solution.
7 — RIGHT OF WITHDRAWAL AND RETURNS
Consumers purchasing at a distance generally have a statutory right to withdraw from the purchase within 14 days from the day after receiving the goods, subject to the exceptions provided by applicable law.
In addition to this statutory right, MARVELLO voluntarily offers a 30-day return period. Unless otherwise stated in our Returns Policy, the 30-day period begins on the day after you receive the goods.
To use the 30-day return period, you must notify us of your decision to return the product within that period and follow the instructions in our Returns Policy. The product must meet the return conditions stated there. These voluntary conditions apply only after the statutory 14-day withdrawal period and do not restrict any mandatory consumer rights.
Full information concerning how to exercise the statutory right of withdrawal, return instructions, exclusions, return costs, product condition requirements and refund timing is set out in our Returns Policy. The Returns Policy forms part of these Terms.
8 — DEFECTIVE OR INCORRECT PRODUCTS
Products must conform to the purchase contract and to applicable consumer law. If a product is defective, damaged on delivery, incorrect or otherwise non-conforming, please contact us as soon as reasonably possible and provide your order details and a description of the issue.
Consumers in Sweden have a statutory right to complain about an original defect for three years. A complaint made within two months after the defect was discovered is always considered to have been made within a reasonable time.
Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction, reimbursement of reasonable costs or cancellation of the purchase. We do not exclude or restrict any mandatory remedy.
9 — INTELLECTUAL PROPERTY
The Services and all content made available through them, including the MARVELLO name, trademarks, logos, product names, product designs, photographs, films, text, graphics, layout and other materials, are owned by or licensed to MARVELLO and are protected by applicable intellectual-property laws.
You may access the Services for personal, non-commercial use. You may not reproduce, modify, distribute, sell, license, publish, scrape, commercially exploit or create derivative works from any part of the Services without prior written permission, except where expressly permitted by law.
No right, title or licence is transferred to you other than the limited right to use the Services in accordance with these Terms.
10 — ACCEPTABLE USE
You must not use the Services unlawfully, fraudulently or in a manner that infringes the rights of another person. You must not attempt to gain unauthorised access, introduce malicious code, interfere with security or operation, harvest personal information, impersonate another person, or use automated means to copy or extract content without our written permission.
You must not use the Services to submit content that is unlawful, misleading, defamatory, discriminatory, abusive, infringing or otherwise harmful.
We may restrict access where reasonably necessary to prevent misuse, protect security, comply with law or enforce these Terms.
11 — THIRD-PARTY SERVICES AND LINKS
The Services may include payment, delivery, analytics, account or other functions provided by third parties, and may contain links to third-party websites. Those third parties may apply their own terms and privacy notices.
We are not responsible for third-party websites or services that we do not control. This does not affect any responsibility that MARVELLO has to you for fulfilling a purchase contract or any liability that cannot lawfully be excluded.
12 — LIABILITY
MARVELLO is responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to exercise reasonable care and skill.
We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability arising under mandatory consumer law.
To the extent permitted by law, we are not responsible for indirect or unforeseeable loss, loss caused by your misuse of the Services or products, or business losses arising from consumer use of the Services.
Nothing in this section affects your statutory rights or the remedies available for defective goods, delayed delivery or other breaches of a consumer contract.
13 — EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by an event outside our reasonable control, such as serious transport disruption, natural disaster, epidemic, industrial action, governmental action, war, civil disorder, interruption of utilities or failure of essential communications systems.
Where such an event affects an accepted order, we will contact you where reasonably possible, take reasonable steps to minimise the effect and perform our obligations as soon as reasonably practicable. Your mandatory rights, including any right to cancel because of substantial delay, remain unaffected.
14 — PRIVACY
We process personal data in accordance with our Privacy Policy and applicable data-protection law. The Privacy Policy explains what information we collect, why we use it, the categories of recipients with whom it may be shared, international transfers, retention periods and your rights.
Independent service providers used to operate the store, process payments, prevent fraud, deliver orders or provide technical services may process personal data for those purposes. The use of such providers does not change the fact that your purchase contract is with MARVELLO.
15 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, our business, legal requirements or regulatory guidance. The version published when you place an order will normally govern that purchase.
Material changes affecting ongoing use of an account or service will be communicated where required by law. Changes do not apply retroactively to remove rights that have already arisen.
16 — SEVERABILITY AND NO WAIVER
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be applied to the greatest extent permitted by law or replaced by the applicable mandatory rule.
A failure or delay in enforcing a right does not waive that right.
17 — GOVERNING LAW AND DISPUTES
These Terms and purchases from MARVELLO are governed by Swedish law. If you are a consumer resident in another country, you also retain the protection of any mandatory consumer-law provisions that apply in your country of residence.
Please contact Client Services first so that we can try to resolve any concern. Consumers may also refer an eligible dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). MARVELLO intends to participate in applicable dispute-resolution procedures and follow ARN recommendations.
Disputes may be brought before the competent courts determined under applicable law. Nothing in these Terms deprives a consumer of the right to bring proceedings in a court that has jurisdiction under mandatory law.
